Corboy & Demetrio Obtains Order for UPS to Preserve Evidence in Pedestrian Crash

A Cook County Circuit Judge has ordered UPS to preserve evidence in a pedestrian crash involving an Evanston woman crossing the street near her home.

Online PR News – 22-January-2015 – Chicago – Corboy & Demetrio has obtained an Emergency Order of Protection requiring UPS to preserve and protect evidence in the Dec. 22, 2014 pedestrian crash involving a UPS truck, which struck an Evanston woman, crushing her under its full weight for 30 minutes until firefighters freed her.

The order was granted by Cook County Circuit Judge James N. O'Hara and requires UPS to preserve all the cell phone records of the truck’s driver, as well as all data recording devices and/or systems for both the truck and its driver at the time of the crash and the 24 hours prior.

The order comes four days after attorney Michael K. Demetrio of Corboy & Demetrio filed a negligence lawsuit against UPS on behalf of Erin Hinner, 30, who suffered life threatening injuries and was crushed from her hands to her legs.

The Order will give us access to what could be key information in finding out how and why a driver would knock down and drive over a pedestrian who was in a cross walk.

Hinner was crossing Ashland Avenue in the crosswalk at Central Street when she was hit by the UPS truck. The truck rolled over her and pinned her body under its axle. Hinner, a new mother, was rushed to the hospital in critical condition and was put in a drug-induced coma to help save her life.

"The Order will give us access to what could be key information in finding out how and why a driver would knock down and drive over a pedestrian who was in a cross walk at five o’clock in the evening," Demetrio said.

Case #2015L411, Erin L. Hinner v. United Parcel Service, Inc. and Gabriel Garcia, Cook County Circuit Court filed on Jan. 15, 2015. Order of Protection granted on Jan. 20, 2015.
